Terms of Service
1. Parties and definitions
"KingCare", "we", "us" means Mandy Support Ltd, trading as KingCare, ICO registration ZB763838, registered in England and Wales.
"You", "Customer" means the organisation or individual subscribing to the KingCare service and any authorised users within that organisation.
"Service" means the KingCare software-as-a-service platform, including all features, APIs, and associated documentation.
"Children's data" means any personal data relating to children in your care entered into the Service by your staff.
2. The Service
KingCare provides a digital records management platform for children's residential care providers. The Service enables staff to create and manage daily logs, incident records, Annex A assessments, Regulation 45 reviews, and related documentation required by the Children's Homes (England) Regulations 2015.
We reserve the right to modify, suspend or discontinue any part of the Service with reasonable notice. We will not remove features that are material to your compliance obligations without at least 60 days' advance notice.
3. Account registration
To use the Service, you must:
- Provide accurate and complete registration information
- Be at least 18 years old and authorised to enter into contracts on behalf of your organisation
- Maintain the security of your account credentials
- Notify us immediately of any unauthorised access at branson@kingcare.uk
You are responsible for all activity that occurs under your account, including actions taken by your staff members.
4. Subscription and payment
4.1 Plans and billing
The Service is available on monthly subscription plans (Starter, Professional, Inspector-Ready) as published on our pricing page. Prices are in GBP and exclusive of VAT where applicable.
Subscriptions are billed monthly in advance via Stripe. Your subscription renews automatically unless cancelled.
4.2 Free trial
New accounts receive a 14-day free trial. No credit card is required to start. At the end of the trial period, you must enter payment details to continue using the Service.
4.3 Cancellation and refunds
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain full access until then. We do not offer partial-month refunds except where required by law.
4.4 Price changes
We will give you at least 30 days' notice of any price increase. If you do not cancel before the new price takes effect, you accept the new price.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any regulation, including the Children's Homes (England) Regulations 2015
- Enter false, misleading or fabricated records about children in your care
- Share account credentials with individuals outside your organisation
- Attempt to access data belonging to other organisations
- Reverse engineer, decompile or copy any part of the Service
- Transmit malware, spam, or any content that interferes with the Service's integrity
- Use the Service to process data unrelated to children's residential care
We reserve the right to suspend accounts that violate these terms, with or without notice depending on the severity of the breach.
6. Data and privacy
You retain ownership of all data you upload to the Service, including children's records. You grant KingCare a limited licence to process that data solely for the purpose of providing the Service.
As the registered provider of a children's home, you are the Data Controller for children's personal data. KingCare acts as your Data Processor. Our Data Processing Agreement forms part of these Terms.
Our Privacy Policy explains how we handle personal data relating to account holders and staff.
7. Data portability and deletion
On cancellation, you may request a full export of your data in JSON or CSV format within 90 days of cancellation. After 90 days, your data will be securely deleted from our systems, except where retention is required by law.
You may request data deletion at any time by emailing branson@kingcare.uk. Children's records cannot be deleted mid-subscription without your explicit instruction — you are responsible for ensuring any deletion complies with your regulatory obligations.
8. Intellectual property
KingCare and all associated trademarks, software, documentation, and platform features are owned by Mandy Support Ltd. These Terms do not grant you any intellectual property rights in the Service beyond the right to use it as described.
You retain full intellectual property rights in your data. KingCare will not use your data to train machine learning models or for any purpose other than providing the Service.
9. Service availability and uptime
We target 99.5% monthly uptime, excluding scheduled maintenance. We will provide at least 24 hours' advance notice of planned downtime where possible.
The Service is not intended to be the sole or primary means of compliance record-keeping. You are responsible for maintaining adequate backup procedures and for ensuring your regulatory obligations are met regardless of Service availability.
10. Limitation of liability
To the maximum extent permitted by law:
- KingCare is not liable for any indirect, incidental, special, or consequential loss arising from your use of the Service
- Our total liability to you in any 12-month period is capped at the total subscription fees you paid in that period
- We are not liable for any regulatory enforcement action, Ofsted grading outcome, or other consequence arising from your use or non-use of the Service
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other matter that cannot be excluded by law.
11. Warranties and disclaimers
KingCare provides the Service "as is." We warrant that we will provide the Service with reasonable care and skill. We do not warrant that:
- The Service is error-free or continuously available
- Using the Service will guarantee a particular Ofsted inspection outcome
- The Service constitutes legal, regulatory or professional advice
The evidence triangle methodology, SCCIF guidance, and Annex A templates are provided for informational purposes and are not a substitute for professional regulatory advice.
12. Indemnity
You agree to indemnify KingCare against any claims, losses or costs (including reasonable legal costs) arising from your breach of these Terms, your misuse of the Service, or any claim by a third party relating to data you entered into the Service.
13. Termination
Either party may terminate these Terms on 30 days' written notice. We may terminate immediately if you breach Section 5 (Acceptable Use) or fail to pay a subscription fee within 14 days of the due date.
On termination, your access to the Service will cease. Sections 6, 7, 8, 10, 11, 12 and 14 survive termination.
14. Governing law and disputes
These Terms are governed by the laws of England and Wales. Any dispute that cannot be resolved by negotiation will be referred to the courts of England and Wales, which have exclusive jurisdiction.
We encourage you to contact us first at branson@kingcare.uk — most issues can be resolved quickly without formal proceedings.
15. Changes to these Terms
We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
